Applicant and Worker Privacy Notice

Jazwares is committed to protecting the privacy and security of your personal information. This Applicant Privacy Notice describes how we collect, use, and disclose personal information about individuals who wish to be considered for employment.

In general, we collect job application, background check, and device information from applicants. We use this information for our Human Resources (HR) operations and recruitment activities, for business-related purposes, and to maintain legal compliance or enforce our legal rights. We do not use applicant personal information for purposes other than those set forth in this Notice, and we do not sell applicant personal information.

2.0 Definition of Personal Information

For purposes of this Privacy Notice, personal information means any information that identifies or can be used to identify an individual.  Personal information excludes anonymous or de-identified data that is not associated with a particular individual.  

There is a subset of personal information that is deemed sensitive because it can reveal certain categories of information about an individual. This includes government identification numbers like Social Security or passport numbers, account login information, financial account information, racial or ethnic origin, religious or philosophical beliefs, trade union membership, genetic or biometric data used for identification, health information, and information concerning sex life or sexual orientation.

Jazwares retains the personal information we receive as described in this Privacy Notice for as long as necessary to fulfil the purpose(s) for which it was collected, carry out our HR operations, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, comply with applicable laws, or based upon other criteria, including, but not limited to, the sensitivity and volume of such data. We endeavor to retain all personal information in accordance with legal retention requirements and reserve the right to reasonably refuse to delete personal information if deleting such personal information would prevent us from meeting compliance obligations, or otherwise exercising or defending our legal claims.

9.0 Security of Your Personal Information

Jazwares uses technical and organizational measures designed to protect the personal information that we store, transmit, or otherwise process against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access. We regularly consider appropriate new security technology and methods as we maintain and develop our software and systems. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unintentional disclosure. If we learn of a data breach that is likely to affect the security of your personal information, we may attempt to notify you electronically via email consistent with our legal obligations so you can take appropriate protective steps and/or by posting a notice on our website if a data breach occurs. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

These third-party services are not controlled by us. We encourage applicants to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for the privacy practices or content of such other websites or applications.

11.0 Effective Date, Changes to Our Privacy Notice and Practices

This Notice is effective as of the “Last Updated” date indicated at the top. We may revise this Notice from time to time at our sole discretion. If there are any material changes to this Notice, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Notice if you continue your engagement with Jazwares after the new Notice takes effect. The categories of sources from which we collect personal information are described above in the section titled “INFORMATION WE COLLECT.” We use the data we collect about you for the business purposes described above in the section titled “HOW WE USE YOUR INFORMATION.” In addition, we may share any data we hold about you with the parties described above. 

Your Personal Information is not (i) “sold” or (ii) “shared” (for purposes of targeted advertising) by us, nor do we have actual knowledge of any such activity involving the Personal Information of minors under 16 years of age.

Processing of sensitive personal information is carried out exclusively for the purposes outlined above, to the extent permitted under law. This processing activity may include service providers and government entities.

14.0 Supplemental Notice for residents of the European Economic Area and United Kingdom 

This Supplemental Notice provides additional details that apply only to applicants residing in the EEA or UK. 

Data Controller. The controller of your personal information is the Jazwares entity to which you are submitting an application.

Legal Basis for Processing.  We will only process your personal information where we have a legal basis to do so. The legal basis will depend on the reason(s) we collected and need to use your personal information. For processing job application information, we rely on our legitimate interests in the field of recruitment. To collect and process personal information deemed sensitive, such as background check information, we will request your explicit consent or rely on the basis of necessity for carrying out our legal obligations.

Cross-Border Transfers. The Jazwares Group Companies have entered into an Intra-Group Data Protection and Transfer Agreement that includes standard contractual clauses for the transfer of personal information across borders.
